Sheldon Woman Faces Felony Charge After Allegedly Injuring O’Brien County Sheriff

(KIWA) — A Sheldon woman already in custody on domestic abuse charges now faces a felony charge after allegedly injuring the O’Brien County sheriff inside the county jail.

According to a criminal complaint filed with the O’Brien County Clerk of Court’s Office, 25-year-old Fabiola DeLeon Matias was initially arrested Monday. Court records allege she threw vases at a victim and was charged with misdemeanor counts of domestic abuse assault, domestic abuse assault with a weapon and interference with official acts.

Jail staff reported another incident Wednesday while DeLeon Matias was being held in the O’Brien County Jail in Primghar.

According to the complaint, DeLeon Matias was being uncooperative with jail staff when Sheriff Bruce Devereaux and other staff members entered a jail pod and instructed her to return to her cell. She allegedly refused and also declined commands to place her hands behind her back.

The report states DeLeon Matias then collapsed to the ground and continued resisting commands. She is accused of digging her fingernails into Devereaux’s arm, drawing blood, and attempting to kick the sheriff and jail staff.

In addition to the charges connected to her original arrest, DeLeon Matias now faces one count of assault on persons in certain occupations, a Class D felony. A conviction on that charge carries a potential prison sentence of up to five years.

A preliminary hearing is scheduled for August 21.

At last report, DeLeon Matias remained in the O’Brien County Jail in lieu of bond.

A criminal charge is merely an allegation, and the defendant is presumed innocent unless proven guilty in court.
