Rock Valley Man Faces Two Felonies Following Alleged Sioux County Jail Assaults

A Rock Valley man initially arrested following an alleged impaired-driving motorcycle crash now faces two felony charges stemming from separate alleged assaults inside the Sioux County Jail.

The Sioux County Sheriff’s Office says 46-year-old Boby Sithavong was charged Monday with assault on a person in certain occupations with intent to inflict serious injury, a Class C felony, and assault on a person in certain occupations causing bodily injury, a Class D felony.

According to the sheriff’s office, Sithavong allegedly struck a correctional officer multiple times while incarcerated, causing injuries that required medical attention.

Later that day, deputies were assisting correctional officers with another incident involving Sithavong when he allegedly assaulted a deputy and caused bodily injury.

Criminal complaints filed by the Rock Valley Police Department show that Sithavong was initially taken into custody following a motorcycle crash in the 1300 block of Main Street.

According to the complaints, Sithavong arrived at the police department at approximately 9:04 a.m. Monday after crashing the motorcycle and injuring himself. Police allege he was wearing no pants, along with a leather jacket and gloves.

Officers allegedly found a small baggie containing methamphetamine concealed inside one of Sithavong’s gloves and observed indicators of drug impairment.

The complaint says a preliminary breath test registered a blood-alcohol concentration of zero-point-zero-zero-zero percent, which police said was inconsistent with the signs of impairment they observed.

Sithavong initially agreed to participate in a drug influence evaluation but allegedly stopped during the evaluation, telling officers he had “already failed” and that his urine would be “dirty.” Police say he then refused an official request to provide a urine sample for chemical testing.

Sithavong was initially charged with second-offense operating while under the influence, an aggravated misdemeanor, and possession of methamphetamine, a serious misdemeanor. The OWI complaint cites a previous Sioux County OWI conviction or deferred judgment from August 2014.

Sioux County Jail records list all four charges and that he is being held on a $12,000 cash-or-surety bond.
