Rock Valley Man Charged with Third-Degree Burglary

A Rock Valley man is facing a felony burglary charge following an incident in Rock Valley late last month.

37-year-old Ever Adali Rodriguez-Gutierrez of Rock Valley was arrested Thursday, May 7, by the Rock Valley Police Department on a charge of third-degree burglary, a Class D felony. Bond was set at $5,000 cash or surety.

A criminal complaint filed in Sioux County District Court alleges the incident happened around 1:32 a.m. on April 27 in the 1600 block of 18th Street in Rock Valley. Court documents state Rodriguez-Gutierrez was found inside an occupied structure and later told law enforcement he had entered the building to assist another suspect in “getting a couple of doors for a small piece of furniture.”

Investigators allege Rodriguez-Gutierrez did not have permission to enter the structure.

If convicted, Rodriguez-Gutierrez could face up to five years in prison and fines.

Court records indicate probable cause in the case, including admissions or statements made by the defendant, officers observing the alleged crime, and the defendant being located near the scene.

The case remains pending in Sioux County District Court.
